1. Scope and provider

These terms apply to the use of Partomat (partomat.com), provided by insightformer UG (haftungsbeschränkt), Liebigstr. 36, 01187 Dresden, Germany ("we"). Contact details are in the Impressum. They apply to consumers and businesses. Terms of a customer that differ from these do not apply. The contract language is English.

2. The service

Partomat is a browser-based design studio. You describe a part in words, and an AI model of your choice writes a parametric CAD program that you can view, adjust with sliders and download. Templates, dimension sliders, downloads and the manufacturing recommendations are free. AI generation is paid for with prepaid credits.

Manufacturing recommendations, prices and lead times shown in the studio are non-binding estimates. Links to other manufacturing services take you to independent providers; their terms apply there.

3. Account

Buying credits creates an account linked to your email address. Keep access to that email address secure; sign-in links sent there give access to your account. Tell us without delay if you suspect misuse.

4. AI credits and prices

  • Credits are a prepaid balance in US dollars. All prices include VAT.
  • Each AI request reduces your balance by the price shown in the model picker for the selected model. This covers the AI provider's charge and our service fee. Requests you stop early and automatic repair attempts are charged for the part already processed.
  • A request that has already started is completed even if it takes your balance slightly below zero; the difference is deducted from your next top-up.
  • Prices per request follow the AI providers' prices and can change. The current price is always shown before you send a request.
  • Credits do not expire while your account exists. Credit is not paid out in cash, except where the law requires it.

5. Conclusion of the contract and payment

You choose an amount in the studio and are taken to our payment provider Stripe. By clicking "Buy now" you make a binding offer; the contract is concluded when the payment is confirmed and the credits are added to your account. You receive a confirmation by email. Payment is handled by Stripe; the payment methods offered there apply.

6. Right of withdrawal

Consumers have a statutory right of withdrawal; see our cancellation policy. Credits are digital content that we provide immediately. The right of withdrawal ends early if you expressly agree, before the purchase, that we start immediately and confirm that you know you lose your right of withdrawal once the credits are provided.

7. AI-generated designs

Designs are generated automatically by AI models and are not checked by an engineer. They can contain errors in dimensions, fit, strength or function. You are responsible for checking a design before you manufacture or use a part. Do not use AI-generated designs for safety-critical or load-bearing purposes, or where failure could injure people or damage property, without review by a qualified person. We do not guarantee that a design is suitable for a particular purpose or complies with standards or regulations.

8. Your content and rights

You keep all rights to the descriptions you enter and the designs you create. You grant us the right to process them to provide the service, including sending them to the AI provider you select. We may use anonymous statistics, such as which model produced a valid design, to improve the service and for the public model leaderboard. You make sure your inputs do not infringe the rights of others. To the extent rights in AI output arise, they belong to you; we cannot guarantee that a design is free of third-party rights.

9. Prohibited use

You may not use Partomat to design weapons, firearm parts or other items that are illegal to make or own, to infringe intellectual property, to attack or overload the service, to get around usage limits, or to resell access to it.

10. Availability

We aim for high availability but cannot guarantee uninterrupted operation; maintenance and faults at us or our providers can cause interruptions. AI providers can change or withdraw models; we may adjust the models on offer accordingly.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence we are liable only for breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible and on which you may regularly rely), and then only for the typical, foreseeable damage. Otherwise our liability is excluded. These rules also apply to our staff and agents.

12. Order requests

An order request for manufacturing is non-binding for both sides. A contract for manufacturing is only concluded when we send you a quote and you accept it; the terms stated in the quote then apply.

13. Changes to these terms

We may change these terms for valid reasons, such as new features or changes in the law. We will tell account holders by email at least four weeks before changes take effect. If you do not object within this period, the changes apply; we will point this out in the email. Changes to the price of credits already bought are excluded.

14. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not remove the protection of mandatory provisions of the country where they live. For merchants, the place of jurisdiction is Dresden. If a provision is invalid, the rest of these terms remains valid.
